1. RESIDENTIAL COMMUNITY
– Guests and their visitors must understand and respect that all our Holiday Homes are located in residential (family-oriented and not business or commercial oriented) communities and hence Guest and visitor behavior should be reflective of a family environment.
– Respect residential amenities and the security of the property and as well as neighbors.
– Refrain from any uncivilized / inappropriate behavior.
– Not conduct any illegal or commercial activities inside the property and the premises at any time during their stay.
2. GUESTS & VISITORS
– All Guests and All Visitors must be registered with Operator at least 24-hours in advance (and valid IDs should be presented to the Operator and to the community security/reception), else access may be delayed or rejected.
– Both Guests and Visitors must comply with House Rules and Community Regulations and procedures as set out by security services.
– Children under 14 should be supervised in all recreation areas.
– Guests are responsible for the behavior of their visitors and for ensuring that Visitors comply with these House Rules.
– Maximum number of visitors allowed is one adult and one child under 14 years of age per bedroom, with no more than six visitors, except with the approval of the building or
residential community management and the Licensee’s approval regarding the largest number of guests in special circumstances, not counting a domestic worker or guards room.
– The maximum number of visitors allowed per Unit is two adults and two children under 14 years of age per master bedroom or studio, two adults and one child under 14 years of
age per additional bedroom, and only one person per domestic worker or guard.
– Visitors are allowed to enter the Property anytime between 8am until 10pm time frame only.
– Visitors may not remain in the Holiday Home between 12:00am midnight and 8:00am.
– Visitors access to the community facilities such as pool, gym or the spa may be restricted or limited as per community rules and procedures.
3. ADDITIONAL RESPONSIBILITIES
Guests acknowledge that all properties are residential properties, located in residential buildings/communities. Accordingly no concierge,
– use the property/facilities such as spa/swimming pool/gym, etc. only at designated areas and use them only at their own risk and liability;
– inspect the Property upon checking-in to assure that fittings and furnishings are complete and functional at the time of check-in; if any item is found missing, damaged, stained, children unfriendly or dis-functional then report to Operator within first 24 hours.
– accompany their children in all areas including but not limited to the pool, gym, beach, sea, spa, balcony, terrace, backyard, bedroom and bathrooms and be fully responsible for the safety and well-being of their children.
– Guest is solely responsible for checking, storing & collecting all his personal belongings or valuable items. Operator bears zero-liability against forgotten or lost items.
4. NOISE/DISTURBANCE TO NEIGHBORS
– Guests must not create noise that is offensive to neighbours, during arrival and departure and at any time during occupancy, especially between 10pm-8am. Noise is considered to be too loud if it can be heard by an adjacent neighbour when inside their house with their windows and doors closed.
– Guests are not allowed to enter or use neighbour’s premises including their property, backyard/patio, yard, garden, pool or personal items such as boat, kayak, toys, tools, chairs, etc.
– Guests must notify the Operator of any disputes or complaints from neighbors as soon as is practicable.
– Guests and Visitors must not engage in anti-social behavior and must minimize their impact upon the residential amenity of neighbors and local community.
5. GATHERINGS OR FUNCTIONS
– All sort of parties and gatherings are STRICTLY PROHIBITED.
6. USE OF COMMUNITY FACILITIES
– The swimming pool/spa must be used only between the hours as set by the community management or Operator.
– No glassware is permitted in the pool.
– Guests and visitors must take all reasonable safety measures regarding the swimming pool and spa, in particular with respect to safety risks to children.
7. CHECK-IN AND CHECK-OUT PROCEDURES
– Standard check in time is 3:00PM and checkout is at 11:00am for apartments (and 12:00PM for villas). Unless otherwise arranged with Operator, the set check-out time is crucial for the cleaning team to perform housekeeping duties and to prepare the property for next guest. Therefore, unauthorized late check-outs or in the event the housekeepers cannot enter the Property due to a delay caused by the Guest for any reason – then the Guest will be subject to automatic charge of full-night cost.
– Early check-in/checkout is subject to availability first and prior written Operator’s approval is required. Any unapproved early check is subject to availability and extra charge of full night cost will automatically apply.
– The Property is being rented in AS IS condition; Upon checking-in, Guest is required to inspect the Property; The Guest has to notify the Operator of any major damages found within 24-hours after check-in; Guest is fully responsible for costs to the Property for such major damages that are not reported to Operator on time.
– When absent from the Property the Guest shall close and lock all windows and doors to maintain security and prevent dust, rain and water damage.
– If the Guest is absent from the Property for more than 7 calendar days in a row, then the Guest must notify to the Operator about such absence and allow the Operator to conduct regular inspections to avoid potential water leakages or other unfortunate events.
8. BARBEQUE
– BBQ are not permitted inside ANY apartment, nor its balconies or terraces. Barbeques are only permitted in designated places whereas such facility is provided by Operator or Community Management in advance.
9. SMOKING
– Smoking of cigarretes STRICTLY PROHIBITED indoors/inside the Property at all times.
– Smoking of shisha / hookah is NOT allowed indoors or outdoors for security reasons.
10. NO PET POLICY
– There are only a few specific units in our inventory that accept pets. Additional pet fees are determined on a case by case basis. If Operator authorized a pet at the property the Pet Addendum must be submitted prior to the stay and the Pet Fee must be paid in full.
11. ALTERATIONS
– Guests may not make any alterations to the Unit without prior written approval of the owner of the Unit.
12. WASTE DISPOSAL
– Guests must dispose of garbage and recycling in accordance normal practice at the Unit and building or community and in the allocated bins and areas.
– Guests must not leave rubbish in public or common areas.
– Guests must comply with requirements in relation to the relevant garbage and recycling collection days, as well as any requirements relating to the disposal of garbage or waste
minimization.
13. PARKING
– Guests and visitors are to comply with parking regulations and other requirements set out by Operator and show consideration to neighbours and other vehicles.
– Guests and visitors are supposed to park only in the designated place(s) and to the maximum number of vehicles as instructed by the Operator.

15. DEFINITIONS
– VAT – means Value Added Tax as imposed by Federal Tax Authority under the Federal Decree-Law No. (8) of 2017 and for which the rate is set to 5% rate;
– DTCM – means The Department of Tourism and Commerce Marketing of Dubai;
– DED – means Department of Economic Development in Dubai;
– TDF – means Tourism Dirham Fee as set by DTCM as per Executive Council Resolution No. (2) of 2014 approving the Tourism Dirham Fee in the Emirate of Dubai;
– PSC – means Property Service Charge of 15%;

CONDITIONS APPLICABLE ON STAY FOR ALL GUEST
Terms & Conditions:
- Security Deposit: On the day of check out, The deposit is fully refundable after subject to the condition of the property and deduction of any damages or extra cleaning costs
- In the event of any failure , delay or default in payment by the Tenant under this agreement the present arrangement shall be deemed (Ejari) tenancy contract. All terms, obligations, and liabilities applicable under the governing tenancy laws of the UAE shall immediately apply, and the Tenant shall be bound accordingly.
- We understand that plans can sometimes change. However, due to the nature of short-term rentals and advance preparations made for every stay, all confirmed bookings are non-refundable.
- In the unlikely event that the host is unable to accommodate the stay, the booking amount remains non-refundable
- 30 Days notice period if want to leave the place applicable to each guest who stayed more than 1 Day inside apartment.
- The Guest agrees to take care of the Property and ensure that it is returned in the same condition as it was provided if not, the Guest will pay the damages.
- Maximum number of guests allowed in the property is as per the Host details filled. Any additional guests must be approved by the Owner. Once rent has been received, it is strictly non-refundable under any circumstances, even if the guest does not occupy the property. The guest also waives any right to request a refund or raise disputes against the company at a later stage.
- The Guest is responsible for keeping the Property clean and tidy during their stay.
- The Guest agrees not sublet or assign this Agreement without written consent from the Owner.

- The owner will bear the utility bill up to AED 850/month.
- Guests will pay AED 750/card in case it is lost.
- Any damage caused to the Property, furnishings, appliances, linens, or fixtures during the stay will be a liability for the guests and shall be paid.
- In the event of any damage to the apartment, the Company shall have the full right to deduct the cost of repair or replacement from the security deposit. Should the cost of damage exceed the deposit amount, the Guest shall be liable to immediately pay the remaining balance upon demand, without objection, delay, or further discussion.
- The following items, if damaged may result in additional charges:
- Property, Furniture and Appliances
- Televisions and Electronic Devices
- Windows, Doors or Locks
- Linens and Towels
- Walls and Paint
- Air Conditioning and Electrical Systems
- In case of any damage, the Owner reserves the right to terminate this Agreement immediately and demand compensation for repairs or replacements & deposits are non refundable in case property has damage and it can’t be settled from rent amount. Tenant has to pay for each damage before they settle the account with the company
- Any deposit fee to be refundable only when guest has not done harm to the property
- Any financial loss like damage to the property or its furniture or leaving without mutual consent will lead not to refund the security deposit.
- Pet is not allowed with an agreement ensuring the property and its furniture are returned in their original condition, if any damage amount will be deducted from the deposit.
- No smoking inside the property. Smoking is permitted only in designated outdoor areas.
- The Guest agrees to maintain a reasonable level of noise to avoid disturbing neighbours.
- No illegal activities are allowed on the Property this can lead to take any action by the company and guest has no right to say anything. All rights of the guest is revokable in case guest has been found in any illegal activity.
- Rent once collected will not be returned back in any case the guest has to go immediately or before the due date also guest has to pay additional loss to the company if guest has not given notice period or left the property in any situation.
- The Owner reserves the right to terminate this Agreement if the Guest breaches any terms outlined especially concerning payment, damage to the Property, or illegal behaviour & rent is not returned once received and cancelled by the tenant in between.
- In the event the Tenant terminates the lease and vacates the premises prior to the completion of the agreed Stay period, the tenant shall be liable to pay an early termination penalty equivalent to two (2) months’ rent.
- The Guest agrees to indemnify and hold harmless REST N ROAM VACATION HOMES RENTAL LLC and its agent for any injury, loss, or damage to personal belongings, or any claims arising from the Guest’s stay.
- The Guest acknowledges that Rest N Roam Holiday Homes (hereinafter referred to as the “Company”) shall not be held liable for any loss, theft, or damage to the Guest’s personal belongings during the stay or after their stay regardless of the cause. The Guest is solely responsible for the safekeeping of all personal items and valuables in their presence or not in presence.
- Any personal belongings or items belonging to the Guest shall be returned exclusively to the Guest in person and shall not, under any circumstances, be handed over to any third party.
- In the event that the Guest is taken into custody, detained, or investigated by the CID or Police during their stay, the Company shall bear no responsibility or liability for any loss or damage to personal belongings, or for any other consequences arising therefrom.
- If, during such intervention, any damage occurs to the apartment or its fixtures (including, but not limited to broken doors, locks, furniture, or appliances), the Guest shall be fully responsible for all related repair and replacement costs. The Company reserves the right to deduct such amounts from the Guest’s security deposit or recover them separately from the Guest in anyway and has right not return his items unless paid for property damage and type of monetory loss
- In case the Guest is taken into custody by authorities or detained and leave any belongings behind, the Company shall store such items for a maximum period of One (1) month from the date of incident. Any personal belongings or items belonging to the Guest shall be returned exclusively to the Guest in person and shall not, under any circumstances, be handed over to any third party
- After this period, any unclaimed belongings shall be deemed forfeited and will be disposed of or discarded without any further notice. The Guest shall have no right to claim or recover such items thereafter.
- During the storage period, the Guest shall be liable to pay warehouse/storage charges of AED 500 per day. The Company shall not be obligated to release any belongings until all outstanding warehouse charges, damage repair costs if any are paid. Furtheralso, if detained by UAE authorities or guest has left the place in any circumstance,
- Only after complete payment and clearance of such dues shall the Guest be eligible to collect their belongings from the Company. Failure to make the payment within the stipulated period will result in the permanent forfeiture of all stored items, and the Company shall have full discretion to dispose of them.
- A monthly service charge of AED 2,000 shall be charged by the Company for undertaking this responsibility.
- The Company has the right to recover any damages or warehouse-related charges from the deposit. If the charges exceed the deposit and no claim is made within 90 days, the Company may sell or auction the materials to recover the outstanding amount.
- Under all circumstances, the Company shall not release any materials to any person other than the guest, solely to protect the guest’s interests.
- In the event that the Guest is detained, arrested, or otherwise unavailable, and no communication or update is received from the Guest within three (3) days, the Company shall have the full right to enter the apartment, remove all personal belongings of the Guest, and securely store them in a designated warehouse or storage facility.
- The Company shall not be held liable for any loss, damage, or claim related to the removal, storage, or handling of such items. Storage charges, if applicable, shall be borne by the Guest.
- Upon completion of this process, the Company reserves the right to resume normal operations of the apartment, including but not limited to re-listing, cleaning, and re-renting the property, without any obligation or liability towards the detained Guest.
- If, upon inspection after the Guest’s detention, departure, or check-out, the apartment is found not in its original condition, or if there is any missing inventory, damage, or loss, the Guest shall bear full financial responsibility for all repairs, replacements, and restoration costs as determined by the Company.
- Throughout the duration of the stay, the Guest acknowledges that any loss, damage, or misplacement of personal property, whether due to negligence, accident, detention or any other reason, shall be the sole responsibility of the Guest, and the Company shall not be liable to compensate or entertain any such claims.
- The Company shall not be held responsible or liable for any claims made by the Guest alleging that certain personal items or valuables were present in the apartment. The Company does not verify, record, or take inventory of personal belongings brought in by any Guest. The Company’s responsibility is limited solely to securing the materials actually found and verified within the premises.
- Any subsequent claims by the Guest regarding items allegedly left behind or missing, for which there is no prior verification or proof, shall be considered invalid and unacceptable. The Guest hereby expressly agrees to these conditions and irrevocably waives any right to make or pursue any claim, demand, or dispute for any material, belongings, or monetary value during the stay, in their absence, or after the completion of their stay.
- Both Parties agree that all information, data, documents, discussions, and materials exchanged between them — whether written, verbal, or electronic — shall be treated as strictly confidential. Neither Party shall disclose, share, or communicate any such information to any third party without prior written consent of the other Party.
- This obligation of confidentiality shall remain in effect both during and after the termination of this Agreement. Each Party shall take all reasonable measures to ensure that its employees, agents, or representatives also maintain the confidentiality of such information.
- Any breach of this clause shall entitle the non-breaching Party to seek legal remedies, including but not limited to injunctive relief and compensation for losses incurred.
- Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts of Dubai.
- The stay which is more than a week will act as all conditions of Ejari.
- In the event that the Guest occupies or begins staying in the property without signing the Agreement, such occupancy shall be deemed as full acceptance of the terms and conditions herein, and these mentioned terms & conditions shall be considered valid and enforceable.
